Terms and conditions

1. Scope and provider

These terms apply to all retreats, courses, mentoring programmes and other offerings that you book with me. The provider and organiser is:

Deviating terms apply only if we expressly agree on them in writing.

2. Registration and conclusion of the contract

The descriptions on my website do not yet constitute a binding offer. If you submit a registration or contact form, write to me or arrange a call via the booking calendar, this is initially an enquiry from you. The contract is only concluded once I confirm your registration, usually by email. With my confirmation, your place becomes binding.

An introductory call is free of charge and places you under no obligation.

3. Prices and payment

The price stated for the respective offering applies. You will receive the exact payment methods and deadlines with my confirmation.

For retreats, you pay a deposit of 50 per cent of the total price after my confirmation in order to secure your place. You pay the remaining balance as stated for the respective retreat, in some cases also in cash on site.

4. Cancellation by you (retreats)

If you have to cancel your participation in a retreat, the following cancellation fees apply, depending on when you cancel in text form (Textform, for example by email):

• up to 60 days before the start: the deposit
• 59 to 30 days before the start: 50 per cent of the price
• 29 to 14 days before the start: 75 per cent of the price
• from 13 days before the start and in the event of non-attendance: the full price

You are free to prove that I have incurred no loss or a lower loss. If I am able to fill your place again, the costs are reduced accordingly.

You may send a substitute in your place at any time, provided that person meets the requirements for participation. Rebooking to another date is possible subject to availability. I recommend that you take out travel cancellation insurance.

5. Appointments for mentoring, sessions and courses

You can cancel or reschedule individual appointments (for example mentoring, Healing Sessions or massages) free of charge up to 24 hours in advance. If you cancel later or do not attend, I charge the full price of the appointment. I cannot refund missed sessions of a course or programme. Where possible, you will receive a recording or a replacement session.

6. Cancellation or changes by me

In rare cases, I may have to cancel or change a retreat or an appointment, for example if there are too few participants, in the event of illness or in cases of force majeure. If I cancel, I will refund all amounts already paid in full. If I cancel because there are too few participants, I will inform you no later than 21 days before the start. For costs you have incurred yourself, such as for travel to and from the venue, I am liable only in accordance with section 9.

7. Services not included

Unless expressly stated otherwise for the respective offering, travel to and from the venue and insurance are not included in the price. What is included is set out in the description of the individual retreat or offering.

8. Health and personal responsibility

Participation is at your own responsibility. You are responsible for ensuring that you are fit to take part in the content; this expressly applies to fasting offerings. If you have pre-existing conditions, are pregnant or breastfeeding, or are unsure, please consult your doctor beforehand. My offerings are impulses for self-care and do not replace medical, psychotherapeutic or naturopathic (heilkundliche) treatment.

9. Liability

I am liable without limitation for damage resulting from injury to life, body or health and for damage based on intent or gross negligence. In the case of slight negligence, I am liable only for breaches of material contractual obligations (wesentliche Vertragspflichten), and only up to the amount of the foreseeable damage typical for this type of contract. I accept no liability for items you bring with you unless I am at fault.

10. Right of withdrawal

Retreats and events on a fixed date: For contracts for leisure activities and accommodation on a specific date, there is no statutory right of withdrawal (Widerrufsrecht) (§ 312g(2) No. 9 BGB, German Civil Code). In this case, the cancellation terms in section 4 apply if you cancel.

All other offerings (for example mentoring, online programmes and individual sessions) that you book by email, telephone or via the website: for these, you as a consumer have the following right of withdrawal.

Withdrawal policy (Widerrufsbelehrung)

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day of the conclusion of the contract.

To exercise the right of withdrawal, you must inform me (Marion Thomsen, Gneisenaustr. 40, 10961 Berlin, telephone +49 172 915 6600, email info@marion-khalsa-kaur.com) of your decision to withdraw from this contract by an unequivocal statement (for example a letter sent by post or an email). You may use the model withdrawal form below, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal: If you withdraw from this contract, I shall reimburse to you all payments received from you without undue delay and in any event not later than 14 days from the day on which I am informed about your decision to withdraw from this contract. I will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested to begin the performance of services during the withdrawal period, you shall pay me an amount which is in proportion to what has been provided until you have communicated to me your withdrawal from this contract, in comparison with the full coverage of the contract.

11. Dispute resolution

I am neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle). If you have any questions or disagreements, please feel free to write to me directly; we almost always find a good solution.

12. Applicable law and final provisions

The law of the Federal Republic of Germany applies. If you are a consumer with your habitual residence in another country, you retain the protection afforded by the mandatory provisions of the law of that country. Should any provision of these terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
